CONTRACT
These terms and conditions ("conditions") form the basis of the contract between you and RSB Travel Pty Ltd (also trading as Coal River Coaches & Love Tasmania Tours). It is important that you read the contract carefully to ensure that you understand your rights and obligations. Your contract may also include additional terms and conditions applicable to a special offer or promotion, and/or depending on your transportation/tour and/or destination specific terms. You confirm your understanding and acceptance of the conditions and the contract by paying your booking deposit or otherwise paying any part of the price of your transportation/tour. If you do not understand and accept the conditions and the terms of the contract, you should not make any payment to us. If you make a booking on behalf of any other person, you represent to us that you have their authority to make the booking on their behalf and to legally bind them to the terms of the contract, including the conditions. You, your, guest or passenger means the person who makes the booking and each person covered by the booking. We may amend these conditions from time to time. You will be bound by the current version of the conditions at the time you make your booking.
Force Majeure: Very rarely, we may be forced by “force majeure” to change or terminate your arrangements prior to or after departure. If this situation does occur, we regret we will be unable to make any refunds (unless we obtain any from our suppliers), pay you compensation or meet any costs or expenses you incur as a result. RSB Travel Pty Ltd assumes no liability for any loss, damage, or entry of any nature in whole or in part resulting from an Act of God or any other force majeure condition including without limitation: fire, volcanic eruption, environmental pollution or contamination, inclement weather, earthquake, low or high water levels, flood, water or power shortages or failures, tropical storms or hurricanes, riots or civil commissions or disturbances, and any other acts of a similar nature, sabotage, arrests, strikes or labour disruptions, restraint of rulers or peoples, expropriations, acts of terrorism, war, insurrection, quarantine restrictions, government health advisories, or warnings or alerts of any kind of nature, government seizures, refusal or cancellation or suspension or delay of any government authority or any license, permit or authorisation, damages to its facilities or the travel supplier and its facilities, or any other unforeseen circumstances or any other factors unforeseen by RSB Travel Pty Ltd that impacts negatively on, or hampers, its ability to fulfil any of its contractual conditions. In the event that any of these conditions apply, RSB Travel Pty Ltd shall be excused, discharged, and released from performance to the extent such performance is so limited or prevented, without liability of any kind.
MEANING OF WORDS
- “Destination Specific Terms” means terms and conditions specific to your transport or tour, as published in the tour brochure or on your accepted quotation, therefore forming part of agreement.
- “Force Majeure Event” means any act of God, war, terrorism, fire, flood or any other extreme weather conditions, loss of power, epidemics or pandemics, industrial disputes, slow-downs or other strike activities, riots or civil disturbances, acts of government, semi government or other authorities, inability to obtain any necessary licence or consent and delays caused by sub-contractors, suppliers or other third parties (including telecommunications carriers), material shortages or other disruption to the tour beyond our control.
- “Itinerary” means the schedule for your tour issued by us, subject to any amendments made by us from time to time in accordance with the contract. Alternatively, for charter bookings the itinerary will be provided by you, the client, for RSB Travel to operate the charter.
- “Runsheet” means a chronological timeline or schedule that outlines exactly what happens, when, where, and who is responsible for each element. It acts as a master guide to keep all parties coordinated and on track.
- “Supplier” means any independent contractor engaged by us to provide a tour or any part of a tour.
- “Transportation/Tour” means the specific service booked by you, whether utilising transport services such as transfer or charter, or a fully inclusive travel package and any additional services arranged as an inclusion of your booking.
BOOKING & PAYMENT
By booking transport or a tour you acknowledge your acceptance of our Terms & Conditions.
Payment terms: RSB Travel Pty Ltd requires pre-payment for all transport and tour bookings unless agreed otherwise. A non-refundable deposit of 20% of the total transportation/tour cost is payable at the time of booking. Full payment must be received at least 30 days prior to departure.
Payment Options: If you pay us by credit card, a surcharge will apply with the surcharge amount being advised at the time of payment. There is no surcharge for payments made by cash, cheque or direct transfer to our nominated bank account as shown on your invoice. Please include the reference provided on your invoice. Once payment has been made send an email advising payment to accounts@coalrivercoaches.com.au
Clients who have booked through a travel agent, your travel agent should forward your booking deposit or tour price to us on your behalf. However, payments by you to your travel agent are not considered to be payments by you to us. We will consider payment has been received by us only when we receive payment from your travel agent.
ITINERARY AND CHANGES
For multiday tours a detailed itinerary/runsheet is required no later that 14 days prior to tour departure.
Any changes or additions made to your itinerary will incur additional costs. If you wish to change any component of your booking you must contact us. We may accept or reject your request at our absolute discretion pending driver and vehicle availability (where applicable) and supplier availability in all cases.
Your quotation may be subject to additional costs without consultation where the following changes made by the client occur after acceptance and confirmation of a booking or during coach transport:
- (a) Any addition to the itinerary in departure times, wait times and return times.
- (b) Change of coach type or size.
- (c) Requests of our driver to change routes outside of accepted itinerary including additional pick-up and drop-off locations.
